Hi there,

What happens if an architect tells you that you do not need planning permission for some work. Then after you have built it you are ordered to take it down by the courts? Would you have the right to compensation from the architect?

I know as the owner of a property yu should be as informed as you can about these things, but i find the whole planning laws very confusing and i'm sure i'm not the only one.

There is a restaurant near me that had a patio area open to air with a glass surround. then the owner had it enclosed with a retractable roof and four plastic sides that could be rolled up to allow the whole area to be an open area again. The owner was arrogant enough to believe he didn't require planning consent and didn't check anyway, he's got that "I can do anything I want with this council" after he fought for permission over some other project to the hotel he owns and won the day and the council had to pay his costs etc.
He probably won't get retrospective permission now after the people he's bullied and upset on the way so now he's blaming the architects for his mistake.
If no checks were made at the time it is his liability.
